Yes, an Indian resident can buy FBTC — legally, in US dollars, under the RBI's Liberalised Remittance Scheme (LRS). FBTC (Fidelity Wise Origin Bitcoin Fund) trades on CBOE BZX. It pays no distribution. FBTC is the second-largest spot Bitcoin ETF in the US, with Fidelity self-custodying its Bitcoin through Fidelity Digital Assets rather than relying on a third-party custodian. For Indian investors, the key advantage over buying Bitcoin on Indian exchanges: FBTC gains are taxed at 12.5% LTCG under Section 112, not the 30% flat VDA rate.

The 30-second version

  • Legal and simple. Buy FBTC via Vested, INDmoney, or Interactive Brokers India.
  • No distribution. No US withholding or Form 44 complexity.
  • India tax: FBTC gains taxed at 12.5% LTCG after 24 months (Section 112) — not the 30% VDA rate. Shorter holds at slab rate.
  • Estate-tax trap: US-situs ETF units — above $60,000 of total US-situs assets, up to 40% US estate tax, no treaty relief.
  • FBTC vs IBIT: Both are 0.25% TER, both track spot Bitcoin. IBIT uses Coinbase custody; FBTC uses Fidelity Digital Assets (self-custody). For most Indian investors, either is equally suitable. IBIT has higher AUM and volume; FBTC has no third-party custodian dependency.

How to buy it — 3 steps

  1. Open an account and finish KYC. Use IBKR for the widest access and best execution, Rovia for a combined RSU + LRS experience, or INDmoney / Vested for a simple India-funded flow.
  2. Fund via the LRS. Cap: $250,000/year. 20% TCS above ₹7 lakh — creditable against income tax.
  3. Place the order. FBTC has good liquidity with tight bid-ask spreads. Market orders work fine for standard position sizes.

What FBTC actually is

FBTC holds spot Bitcoin — one unit of FBTC represents approximately 1/1000th of a Bitcoin (the ratio changes as management fees accrue). Fidelity Digital Assets, a wholly-owned subsidiary of Fidelity Investments, serves as the custodian, holding the actual Bitcoin on behalf of the fund. This means no third-party custodian risk.

The self-custody differentiation: IBIT (BlackRock) uses Coinbase Custody Trust as its Bitcoin custodian. If Coinbase faced regulatory action or operational failure, IBIT's custodian would be affected. FBTC's Bitcoin is held by Fidelity's own regulated subsidiary — a different risk profile. Neither scenario is likely, but for investors with large positions, the distinction matters.

The $60,000 estate-tax trap
